The asylum process begins by filling out Form I-589 within a year of arriving in the U.S. There is no fee to apply. The spouse and children (under 21 and unmarried) who are also in the U.S. can be included in the application at the time of filing or at a later date.
People who apply for asylum can do so after legally or illegally entering the U.S. They must have a well-founded fear of persecution either by their country’s government or by a force beyond the government’s control. They must apply within one year of entering the U.S. However, you may not be eligible for asylum if you had a pervious asylum application denied by an immigration judge or the Board of Immigration Appeals. Furthermore, individuals who can be removed to a safe third country under a two-party or multi-party agreement between the U.S. and other countries will also not be eligible.
