Removal or Deportation Overview

There are many steps to deportation, and none of them are simple. The Illegal Immigration Reform and Immigrant Responsibility Act sets the guidelines for how removal proceedings will go, and it begins with a notice from the Department of Homeland Security ordering the person to appear before an immigration judge. The notification will explain why you’re being ordered to appear, how you allegedly broke the law, that you have a right to an attorney, and list the consequences of failing to appear in court.

You have the right to apply for relief of removal if a judge has determined that you can legally be removed from the country. Relief comes in three main forms – cancellation of removal, adjustment of status, and asylum. If you’re a lawful permanent resident, you are eligible for cancellation of removal if you have lived in the U.S. for seven years, have been a lawful permanent resident for five years, never been convicted of an aggravated felony or terrorism, and never been granted cancellation of removal previously.

If you are not a lawful permanent resident, you won’t be eligible for cancellation of removal unless you have been living in the U.S. for 10 years without committing any crimes. You must also be considered a person of good moral character in those 10 years, and you must show that being removed would result in exceptional hardship on your spouse, parent or child.
