Naturalization Overview

People age 18 or older seeking to become a citizen of the U.S. need to apply for naturalization by filling out an application for naturalization, Form N-400. Applicants must be lawful and permanent residents, i.e. a green card holder. They must also have resided permanently in the U.S. for at least five years and have been physically present in the U.S. for at least 30 months. They must be of good moral character and able speak, read and write in the English language. Furthermore, they must have knowledge of the U.S. government and history, and be willing to take the Oath of Allegiance.

While some naturalization cases are routine, others can be fairly complex, but it is advisable to seek the help of an immigration attorney in either case. The process requires careful planning and study of the client’s immigration, legal, social, travel, and employment background.

One of the more misunderstood issues surrounding the naturalization process is in the continuity of residence requirement. For instance, a prospective applicant might believe that because they left the U.S. for just under six months, they are not allowed to apply, which is false. An absence of six month or more, but less than a year, does break the continuity of a person’s residence for naturalization purposes, but not if they can offer a reasonable explanation for the absence.
